Acceptable Use Policy

This acceptable use policy lists what may be sent through ColdTexting. Every recipient must have opted in, purchased or rented lists are prohibited, SHAFT content and deceptive messages are not allowed, and accounts that cause complaints or carrier violations are suspended.
1. Why this policy exists
Every message sent through ColdTexting travels over carrier networks that protect their subscribers from spam, and one abusive account can get numbers blocked for everyone. This policy lists what you may send and how. It is part of the Terms of Service and applies to every user, workspace and sub-account.
2. Consent comes first
- Text only people who gave consent directly to your business for the kind of message you send. Marketing and sales texts need prior express written consent that names your business.
- Import contacts only with their consent source, timestamp and the form text they agreed to. ColdTexting rejects imports without a consent source.
- Consent is not transferable. Consent given to another business, a partner, a lead seller or a sister brand does not cover your messages.
- Keep proof of consent for as long as the law requires, and for at least four years.
3. Lists you may not use
- purchased, rented, traded or shared lists,
- numbers scraped from websites, directories, social networks or listing portals,
- numbers appended to records by a data enrichment tool,
- co-registration or lead generation lists that do not name your business in the consent text,
- numbers on the National Do Not Call Registry or a state do not call list, unless the person gave you consent or the law allows it.
4. Content you may not send
- SHAFT content. Sex and adult content, hate speech, alcohol, firearms and tobacco or vaping, including cannabis, CBD, kratom and similar products.
- High risk financial offers without approval. Payday and short term loans, credit repair, debt relief or consolidation, cryptocurrency, trading signals, gambling, sweepstakes and work from home or get rich offers, unless your business is licensed where required and the use case is registered with and approved by carriers.
- Debt collection without compliance. Collection messages are allowed only from a registered collection campaign that follows the Fair Debt Collection Practices Act, Regulation F and state collection laws.
- Deceptive content. Phishing, fake prizes, false urgency, misleading claims, impersonation of another person or business and messages that hide who is texting.
- Harmful content. Harassment, threats, malware, links to illegal downloads and content that targets children.
- Illegal content. Anything that promotes illegal goods or services or breaks the law where the sender or the recipient is.
5. Sending practices you may not use
- Snowshoeing. Spreading traffic across many numbers to stay under carrier filtering limits.
- Number cycling. Replacing numbers that carriers have blocked or flagged in order to keep sending the same traffic.
- Sender spoofing. Sending from a number you do not control or that does not belong to the registered brand.
- Sending outside quiet hours. Marketing and sales texts outside 8 a.m. to 9 p.m. in the recipient's time zone, or outside the narrower window of the recipient's state, such as 8 a.m. to 8 p.m. in Florida, Oklahoma and Maryland.
- Ignoring opt-outs. Texting a contact after STOP, UNSUBSCRIBE, CANCEL, END, QUIT or any clear request to stop, or re-adding an opted-out contact without new consent.
- Excessive frequency. More messages than the contact agreed to, or more than state law allows, such as three sales texts on the same subject in 24 hours.
- Filter evasion. Public URL shorteners, deliberate misspellings, look-alike characters or content that does not match the registered campaign.
6. What every message must include
- your business or brand name,
- a clear way to opt out, such as Reply STOP to opt out, in the first message and in marketing messages,
- content that matches the use case and sample messages registered for your 10DLC campaign,
- links only on a domain you control.

7. Opt-out handling
ColdTexting suppresses a number on every number, campaign and sequence in your workspace as soon as the contact replies STOP or a similar keyword, and sends one confirmation without marketing content. You may not turn this off, work around it or text the number from another tool on our behalf.
8. Monitoring and enforcement
We check messages, complaint and opt-out rates and carrier reports. When we find a violation, we may hold messages, pause sending, require changes, suspend the workspace or close the account, depending on how serious and how repeated it is. Serious or repeated violations end the account without a refund for the current period. You are responsible for carrier fines and fees that result from your violations.
9. Reporting abuse
If you received a text you did not agree to from a business that uses ColdTexting, reply STOP to opt out and write to [email protected] with the sending number, the date and the message text. We investigate every report.
10. Changes
