Marketing Text Message Service for Compliant Campaigns

A marketing text message service schedules promotional SMS campaigns to subscribers who opted in. ColdTexting lets you build segments, write messages with merge fields, schedule by recipient time zone, track delivery, reply and opt-out rates, and blocks any send that fails consent or quiet-hours rules.

Campaign builder

A campaign comes down to three decisions

Who gets it, what it says and when it lands. The builder asks for each one in order and checks the answer before moving on.

  1. Audience. Pick a segment by tag, source, city or last activity. The counter shows how many contacts have a consent record and how many are excluded.
  2. Message. Write once with merge fields such as first name or listing address. The compliance score updates as you type, and the segment count updates with it.
  3. Schedule. Choose a date and a local time. Each contact receives the text at that hour in their own time zone, never outside the allowed window for their state.

Rules in plain language

What makes a marketing text campaign compliant

A marketing text message service is only as safe as the rules it enforces for you. These four carry most of the legal weight.

Prior express written consent

Marketing texts sent with automated software require the recipient's prior express written consent, a clear signed or checked agreement to receive marketing texts from your business. ColdTexting stores it as a consent record on each contact.

Identification

The first words of a campaign text name the business sending it. Carriers flag unbranded texts, and recipients report them as spam far more often.

An easy way out

Each campaign tells people how to opt out, and any reply of STOP, UNSUBSCRIBE, CANCEL, END or QUIT removes them from every future send at once.

Sending hours

Federal rules allow texts between 8 am and 9 pm in the recipient's local time. Several states narrow that window, which is why scheduling follows the contact's time zone.

The stakes are concrete. Under the TCPA, each text sent without valid consent can cost $500, and up to $1,500 if the violation is willful. The deeper rule set, including record keeping, is covered on the TCPA compliance software page.

Timing

When marketing texts are allowed to arrive

The best time to send is a time the law allows and the reader is awake. Late morning on weekdays and late morning on weekends tend to suit most consumer offers.

ColdTexting applies the federal window everywhere and the narrower state window where one exists. A campaign scheduled for 8:30 pm reaches Texas contacts on time and holds Florida contacts until the next morning.

Federal default8 am to 9 pm Yes
Florida8 am to 8 pm Yes
Oklahoma8 am to 8 pm Yes
Washington8 am to 8 pm Yes
Maryland8 am to 8 pm Yes

State rules change, and some also limit how many messages one person receives per day. The scheduler reads the recipient's area code and state on each send.

Measurement

Three numbers that tell you a campaign worked

Delivery rate is the share of texts the carrier accepted for the handset. Reply rate is the share of recipients who answered, which is the real goal of most campaigns. Opt-out rate is the share who replied STOP, and when it climbs above a few percent, the audience or the offer needs another look.

The same builder runs group texting for events and reminders: an RSVP confirmation the day before, a parking note the morning of. For messages that should follow one another, drip texting sequences stop on reply. Examples by industry are collected on the SMS marketing use cases page.
